By using or accessing our Golf Simulators, you hereby agree to the Terms and Conditions listed on this

site in reference to THE HARD DECK SMOKEHOUSE & REC ROOM a division of Primco Commercial

Limited Partnership (“THE HARD DECK SMOKEHOUSE & REC ROOM”, “Company” “we” or “us”).

These terms and conditions are subject to change and can be modified at any time without notice to you.

Be sure to review the Terms and Conditions periodically for updates, as your continued use of the site

signifies your acceptance of any changed terms and conditions outlined in this Terms and Conditions

Agreement. Note that the headings contained in this Terms and Conditions Agreement are inserted for

convenience of reference only and shall not in any way define or affect the meaning, construction, or

scope of any of the provisions contained in this Terms and Conditions.

Damage to THE HARD DECK SMOKEHOUSE & REC ROOM Property

You shall be charged for all egregious property damage to THE HARD DECK SMOKEHOUSE & REC

ROOM by you and the guests using the Simulator during your booking time. Normal wear and tear on the

screens or tee boxes, putting green, tees, borrowed clubs, or other property permitted for use by

customers will not result in a charge.

Registration and Arrival Time

Your simulator time begins precisely at your designated tee time. It is recommended that you arrive at

least 5 minutes before your tee time, or 10 minutes if you are playing for the first time. Time lost due to the

late arrival of you or your guests will not be granted at the end of your tee time. Time lost due to simulator

issues or other factors may be granted or credited at the discretion of THE HARD DECK SMOKEHOUSE &

REC ROOM.

WAIVER AND RELEASE OF LIABILITY:

THE HARD DECK SMOKEHOUSE & REC ROOM is a division of Primco Commercial LP. incorporated in

Alberta, is a limited liability company (“THE HARD DECK SMOKEHOUSE & REC ROOM”).

In booking a tee time, I hereby agree as follows:

(1) To assume the risk of harm, injury or death to myself or my guests which may arise out of my

participation in any manner at THE HARD DECK SMOKEHOUSE & REC ROOM’s facilities;

(2) b. I recognize the physical exertion involved in the use of the building, golf simulator and related

equipment, and attest and certify that I am physically fit to participate safely, and I have not been

advised otherwise by a health care professional

(3) To release and discharge THE HARD DECK SMOKEHOUSE & REC ROOM and its employees,

members, agents, and volunteers from liability for any and all claims and causes of action, of

whatsoever kind of nature, which I or my guests may have as a result of any harm or injury to us

arising from the use of THE HARD DECK SMOKEHOUSE & REC ROOM’s facilities;

(4) To not institute or prosecute any actions or suits at law or in equity, nor aid any institution or

prosecution of any claim, demand, action or cause of action against THE HARD DECK

SMOKEHOUSE & REC ROOM, its employees, members, agents, or volunteers, for any personal

injury, property damage, costs or attorneys’ fees sustained or that might be sustained by myself or

my guests which are related to, resulting from, or connected in any manner with the aforesaid use

of THE HARD DECK SMOKEHOUSE & REC ROOM’s facilities;

(5) That this Waiver and Release of Liability may be pleaded as a complete defense to any action or

proceeding that may be brought or instituted by me or my guests or by our respective heirs or

legal representative heirs or legal representatives; and

(6) That I agree to indemnify and save and hold harmless THE HARD DECK SMOKEHOUSE & REC

ROOM, its employees, members, agents, and volunteers, and each of them from any loss, liability,

damage, or cost, including reasonable attorney’s fees, which arises as a result of our breach of

this Waiver and Release of Liability.

I AM FULLY AWARE OF THE RISKS ASSOCIATED WITH GOLF AND INDOOR GOLF, PARTICULARLY AS

THEY EXIST IN THE CONFINES OF AN ENCLOSED INDOOR AREA, INCLUDING THE POSSIBLE

RECKLESS CONDUCT OF OTHER PARTICIPANTS. I HAVE CAREFULLY READ THIS AGREEMENT,

AGREE TO ACCEPT ANY AND ALL INHERENT RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, OR

DEATH.

I warrant that I have read and understand that this Agreement involves my waiver and release of

significant rights and my assumption of significant indemnification responsibilities in participating in the

Event
